Terms of service

These terms apply when you order a video from appmotion.video. The seller is Dijital Mekan Ltd ("we", "us"), a company registered in England and Wales. By placing an order you agree to these terms, the refund and cancellation policy and the privacy policy. Please read them; they are short and written to be understood.

1. What we sell

We produce motion graphics videos (promo videos, App Store previews, social ads, explainers and similar) for apps and websites, made to the brief and options you choose in the order form: length, formats, resolution, voiceover, languages, music and delivery speed. Prices are shown in US dollars before you pay; Stripe may show and charge the equivalent in your local currency.

2. Your account and your brief

• You need an account to order. Keep your sign-in details safe; you are responsible for what happens under your account.
• You confirm that you own or have the right to use everything you upload or ask us to use (logos, fonts, recordings, screenshots, music references, text) and that it does not infringe anyone else's rights or break any law.
• You must be at least 18 and, if ordering for a company, authorized to bind it.

3. Placing an order and payment

• The order form shows the running total. Your order is placed, and our contract starts, when Stripe confirms your payment. We confirm by e-mail with an invoice.
• Payment is taken in full at the time of ordering. Discount codes must be entered before payment and cannot be applied afterwards.
• Prices exclude any VAT or sales tax that applies to you. Where tax must be collected, it is shown at checkout.
• We may refuse or cancel an order that contains unlawful, hateful, adult or misleading content, infringes third-party rights, or that we cannot deliver to our standard. If we cancel, you receive a full refund.

4. How production works

1. Brief. If something we need is missing we pause the order and ask you from your dashboard. The delivery time only starts once we have what we need.
2. Script. We write the script and send it to you for approval. You can approve it or ask for changes. If you do not respond within 4 hours (1 hour for express orders), the script is treated as approved so your delivery time does not slip.
3. Production. Once the script is approved we design and animate. Production is deemed to have started when the status changes to "In production"; from that moment the cancellation rules in section 6 apply.
4. Delivery. Standard delivery is within 24 hours of the later of payment and receipt of a complete brief, counted in calendar hours, seven days a week. Express delivery, if you chose it, is within 6 hours from the same point. Time we spend waiting for information we have asked you for is added to the delivery time. The video appears in your dashboard for you to watch and download.
5. Revisions. 1 revision round is included. A round is one consolidated list of changes within the original brief; changes to the brief itself (new features, a different length, a new format) are a new order or a paid add-on. Correcting our own mistakes, or anything that does not match the approved script and brief, never uses a round. Extra rounds cost $19 each and can be requested from your dashboard.
6. Approval. You can approve the delivered video at any time. If we do not hear from you within 7 days of delivery, the order completes automatically.

5. Delivery times are estimates

We keep to the delivery times above in the great majority of orders and tell you promptly if something delays yours. Delivery times are estimates, not guarantees, and depend on a complete brief and timely responses from you. If we cannot deliver at all, section 6 of the refund policy applies and you receive your money back.

6. Cancellation and refunds

You can cancel an order for a full refund at any time before production starts, directly from your dashboard. After production has started we cannot refund, because the work is bespoke and largely done. The full rules, including what happens if we fail to deliver, are in the refund and cancellation policy, which forms part of these terms.

If you are a consumer (ordering for purposes outside a trade or business), you have a legal right to cancel a distance contract for services within 14 days. By placing the order you ask us to start the service straight away, within that period, and you acknowledge that once production has started you lose the right to cancel and that if you cancel before that you pay nothing for the work done (we refund in full).

7. Rights in the video

• When the order is paid in full you receive full commercial rights to the delivered video: you may publish, broadcast, edit and use it anywhere, for as long as you like, in connection with your product and business.
• Music and voiceovers are produced for your video with licenses that permit commercial use. AI voices are cleared for commercial projects; you may not use the voice track separately from the video.
• Project files (After Effects, Remotion or other source files) are not included and remain ours.
• We keep the right to show the finished video in our portfolio and on our social channels, unless you unticked the portfolio box on the order form or ask us not to by message. We never show your uploaded files or unfinished work.
• You keep all rights in the material you provide.

8. Your responsibilities

You are responsible for the accuracy of the information in your brief, for checking the delivered video before publishing it, and for compliance of your final use with platform rules (for example the App Store and Google Play guidelines) and advertising law in your markets. We prepare App Store previews to Apple's published technical specifications but cannot guarantee approval by Apple or Google.

9. Our liability

• Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law.
• Otherwise our total liability for any order is limited to the amount you paid for that order.
• We are not liable for loss of profit, revenue, data or goodwill, or for indirect or consequential loss, or for delays caused by incomplete briefs, late responses, or events outside our reasonable control.
• Consumers keep every right they have under consumer law; these limits do not reduce them.

10. Files and retention

Delivered videos stay available in your dashboard for 365 days after delivery; download your own copy within that time. Files you upload are deleted 90 days after the order completes. Unfinished orders are deleted after 30 days.

11. Changes to the service and these terms

We may change prices, options and these terms for future orders. Orders already paid keep the price and terms that applied when they were placed.

12. Law and disputes

These terms are governed by the law of England and Wales and the courts of England and Wales have jurisdiction. If you are a consumer living elsewhere, you also benefit from the mandatory consumer protections of your country and may bring a claim in its courts.
